Have you made a Will? -NO?

Your will is one of the most important documents you will ever make.
Making a Will is the only way to ensure that upon your death your estate and affairs are dealt with in accordance with your wishes.

Making a Will saves time, heartache and stress for your loved
ones after you have gone. If you haven't made a Will, then
The Government has effectively written one for you:
Called the rules of intestacy.
This means that the Law decides who inherit your estate.
Your loved one’s may not like the results, but without a Will
There is nothing they can do.

If you die “Intestate” (without making a will) the law decides what
happens to your estate and how it is distributed. Many people, who
are married or in a civil partnership assume that when they die,
everything they own will automatically pass onto their spouse/civil partner. This is not the case.
It is a common misunderstanding that husbands and wives are entitled to inherit everything from each other. THEY ARE NOT.

The rules of intestacy mean that for a married couple, when one dies, the survivor does not necessarily inherit everything (Including the family home.)
The surviving spouse can be forced to sell the home they live in to pay off other relatives. As the rules of intestacy were put in place over 80 years ago they do not bear much relation to modern day family situations. This can have a devastating affect especially in the event of unmarried partners. It is also a common misunderstanding that living together as partners
(Common Law Husband and Wife) They would be entitled to each other’s estate. THEY ARE NOT.

CHILDREN
Appointing a legal guardian is one of the most important parts of making a will for those with children under 18. If you don’t have a Will then the Social Services and the courts will become involved to appoint a legal guardian for your children. This could lead to your children being placed into care should you die without making a Will.

As many as 85% of the population have not yet made a Will, and many are not even aware of what would happen if they died intestate. Last year in the England and Wales thousands of family homes had to be sold after someone died without making a will.
